DealerX Partners, LLC v. Domain Manager, Visionamics/Citytwist Inc. / Lyndon Griffin: WIPO Case D2017-1680

In the WIPO case D2017-1680, DealerX Partners, LLC, a digital marketing specialist for automobile dealers, filed a complaint against Domain Manager, Visionamics/Citytwist Inc., and Lyndon Griffin over the domain names “conquestautomotive.com,” “conquest.email,” and “conquest.marketing.” DealerX claimed infringement of its CONQUEST SERVICE® trademark, asserting the domains were identical and used in bad faith. However, the Panel found that the term “conquest” was commonly used in automotive marketing and that Visionamics/Citytwist Inc. was commonly known by “conquestautomotive.com.” The Panel concluded that DealerX failed to prove bad faith registration or use by Visionamics/Citytwist Inc. and found DealerX guilty of Reverse Domain Name Hijacking, as they omitted key information and overreached in their trademark claims.
