RDNH Case D2008-1537

The WIPO case D2008-1537 involved a dispute over the domain name “image3d.net” between the complainant, Richard L. Dubnow of Oregon, USA, and the respondent, International Brains Center S.L. of Madrid, Spain. Dubnow, operating under the business Image3D, held a US registered trademark and an international trademark application for IMAGE3D. The domain was registered by the respondent in 2002 and used for a website offering 3D animation and related services. The panel found that Dubnow failed to prove the domain name was identical or confusingly similar to a trademark in which he had rights, as the US registered trademark did not demonstrate acquired distinctiveness and the status of the international trademark application was unclear. Additionally, there was no evidence of bad faith registration or use by the respondent, as the domain predated Dubnow’s trademark registrations. The complaint was thus denied.
