Foundation Fitness LLC held various trademarks related to the word “Stages”. The domain name was registered in December 2001, and Jiang Zhou acquired it in December 2014.
Foundation Fitness LLC argued that the domain name was identical to their trademark and that Zhou had no legitimate interests in it, claiming it was registered and used in bad faith, primarily for selling to the complainant at a high price. Zhou countered that he was unaware of Foundation Fitness LLC’s trademarks and had legitimate interest in the domain name due to its common English meaning. He also denied bad faith in registration and use.
The panel concluded that while the domain name was identical to the complainant’s trademark, there was insufficient evidence of Zhou’s bad faith in registration and use.
