In the WIPO case Datacom Group Limited vs. Datacom Communications Pty Ltd (Case No. DAU2019-0032), the dispute revolved around the domain names “datacom.net.au” and “datacomaccounting.net.au.” Datacom Group Limited, an Australian IT services company, filed a complaint against Datacom Communications Pty Ltd, asserting trademark infringement. Datacom Communications Pty Ltd had been using the “Datacom” name since 1987, predating Datacom Group Limited’s use and registration of similar trademarks.
The WIPO panel found that Datacom Communications Pty Ltd had legitimate interests in the disputed domain names, as their use of the “Datacom” name was established long before Datacom Group Limited’s entry into the Australian market. Consequently, the complaint was denied, and Datacom Group Limited was found to have engaged in reverse domain name hijacking, using the policy in an attempt to unfairly acquire the domain names.
