Digital Revolution B.V. vs. Onyx Domain Solutions: A WIPO Domain Name Dispute (Case No. D2018-2949)

In the case D2018-2949, Digital Revolution B.V. from the Netherlands contested the domain name <123ink.com>, held by Onyx Domain Solutions from the United States. Digital Revolution, operating a webshop for printer supplies at <123inkt.nl> since 2000, claimed that the domain name <123ink.com> was confusingly similar to its European trademark registration for 123INKT. The disputed domain name was registered in 1999 and acquired by Onyx Domain Solutions in 2009, resolving to a pay-per-click parking page with links to ink cartridge products.

The WIPO panel found the disputed domain name to be confusingly similar to Digital Revolution’s trademark. However, it was determined that Onyx Domain Solutions had rights and legitimate interests in the domain name. The Panel concluded that the domain name had not been registered and used in bad faith by Onyx Domain Solutions. Therefore, the complaint was denied, and Digital Revolution was found to have engaged in Reverse Domain Name Hijacking, as they had filed the complaint despite clear Policy precedents that the claim was bound to fail.
