The WIPO case D2014-0096 involved a dispute over the domain name “inbay.com.” The complainant, Inbay Limited, a UK-based IT support service company, filed the complaint against Ronald Tse, doing business as Neosparx International in Hong Kong. Inbay Limited, incorporated in 2008, held a UK trademark for “INBAY” registered in 2013. Tse registered “inbay.com” in 2007, before the complainant’s trademark registration. The panel found that while the domain name was identical to Inbay Limited’s trademark, Tse had registered the domain name before the complainant’s existence, negating bad faith registration. Consequently, the complaint was denied, and the panel also found the case of Reverse Domain Name Hijacking against Inbay Limited, as they pursued the complaint despite Tse’s prior registration of the domain name.
