The WIPO domain name dispute case D2014-0664 involved Personal Communication Systems, Inc. against CDN Properties Incorporated concerning the domain name . The Complainant, based in North Carolina, USA, provided cloud-based communications technology to medical practices and owned the HEALTHWAVE trademark. The Respondent, based in Panama, had registered the disputed domain name in 2002, predating the Complainant’s trademark registration. The domain name was used for pay-per-click advertising and was offered for sale. The Complainant alleged that the Respondent had no legitimate interest in the domain and had registered and used it in bad faith. However, the Panel found that the Complainant could not prove bad faith registration or use since the domain name was registered long before the Complainant’s trademark rights existed. Consequently, the complaint was denied and deemed an abuse of the administrative proceeding, leading to a finding of Reverse Domain Name Hijacking against the Complainant.
