The domain name dispute case D2018-1207 involved Crypto World Journal Inc., based in Dover, Delaware, USA, as the complainant, and Xiamen Privacy Protection Service Co., Ltd. / Lin Xiao Feng of Xiamen, Fujian, China, as the respondent. The contested domain name was , registered with eName Technology Co., Ltd. The complaint was filed with the WIPO Arbitration and Mediation Center on May 29, 2018.
Crypto World Journal Inc. claimed rights based on its application for the CWJ trademark in the United States, filed on May 2, 2018. The respondent, an individual and domain name investor from China, acquired the domain name on December 2, 2016. The domain name had been registered since March 14, 1999, but was not actively used.
The Complainant contended that the domain name was identical to its CWJ trademark and that the respondent had no legitimate interest in it, asserting it was registered and used in bad faith. The respondent argued against these claims, stating they were a legitimate investor in domain names and had no knowledge of the complainant’s trademark at the time of acquisition.
The WIPO panel found that the domain name was registered before the complainant had rights in the CWJ trademark and that the respondent had legitimate interests in the domain name as an investor. As such, the complaint was denied, and the panel declared it an instance of reverse domain name hijacking by Crypto World Journal Inc.
