The WIPO Domain Name Dispute Case DAU2020-0006

The case, involving the domain name “threebestrated.com.au”, was contested between Three Best Rated Pty Ltd, an Australian company, and Signature Profit LLC, a US company. The Complainant, Three Best Rated Pty Ltd, argued that they had trademark rights to “Three Best Rated” and claimed that Signature Profit LLC had no legitimate interests in the domain name, which was registered and used in bad faith. However, Signature Profit LLC had been using the “Three Best Rated” mark since 2017 in Australia and filed an Australian trademark application for it. They argued that their use of the domain name was legitimate and not in bad faith. The Panel found that Signature Profit LLC had a bona fide offering of business services in Australia using the disputed domain name, which demonstrated legitimate interests. Consequently, the complaint was denied on May 11, 2020, and deemed a case of reverse domain name hijacking due to the Complainant’s apparent attempt to acquire the domain name for their own business, diverting goodwill from Signature Profit LLC​​.
