The WIPO Domain Name Dispute of Miray Software AG vs. Perfect Privacy, LLC / Collin Woo

In the WIPO case D2018-0845, Miray Software AG of Germany filed a complaint against Perfect Privacy, LLC and Collin Woo of the United States concerning the domain name “miray.com.” Miray Software, founded in 1996 and renamed in 2000, discovered the domain was already registered by Woo when they attempted to acquire it. Despite Miray Software’s attempts to purchase the domain in subsequent years, no agreement was reached.
Woo registered “miray.com” in 2000, claiming it was for a real estate investment business and because “Miray” means “the future” in Korean. Miray Software alleged that the domain was identical or confusingly similar to its trademark, that Woo had no legitimate interests in the domain, and that it was registered and used in bad faith.
However, the WIPO Panel found no evidence of bad faith registration by Woo, as Miray Software’s trademark was neither filed nor registered when the domain was created. The Panel determined that the complaint failed, as Miray Software could not prove Woo was targeting its nascent trademark rights.
