Do National Internet Sovereignty Laws Threaten Global DNS Interoperability?

The Domain Name System (DNS) is one of the foundational elements of the global internet, serving as a distributed directory that translates human-readable domain names into numerical IP addresses. Its seamless functionality depends on a high level of global coordination, standardization, and technical neutrality. The DNS is managed through a hierarchical structure under the stewardship of the Internet Corporation for Assigned Names and Numbers (ICANN), which oversees the root zone and delegates authority to top-level domain operators. This structure enables users from any country to resolve domain names across borders, providing the technical backbone for a unified, interoperable internet. However, the rise of national “internet sovereignty” laws—legislation designed to assert state control over digital infrastructure, content, and data—poses a growing challenge to this model. As more governments seek to assert authority over how the internet operates within their borders, the risk of fragmenting the DNS and undermining its global interoperability becomes increasingly real.

Internet sovereignty, as a concept, has gained traction particularly in countries that view the open internet as a threat to national security, cultural identity, or political control. Russia and China have been at the forefront of this movement, passing laws that mandate the creation of alternative DNS infrastructures, localized data storage, and the ability to sever domestic internet traffic from the global network. Russia’s “sovereign internet” law, enacted in 2019, grants its national telecommunications regulator, Roskomnadzor, the authority to route all domestic internet traffic through government-controlled nodes. It also mandates the use of a national domain name system capable of functioning independently if disconnected from the global internet. China’s approach is even more entrenched, with its Great Firewall filtering DNS queries, blocking foreign domains, and enforcing a state-controlled domain name registry that operates alongside the global DNS but under much stricter political and commercial oversight.

While these measures are framed by their proponents as necessary for cybersecurity, censorship resistance, and cultural protection, they also introduce technical and policy inconsistencies that jeopardize the global interoperability of the DNS. A single, authoritative DNS root ensures that domain name resolutions are consistent regardless of user location. Fragmenting that root—by introducing alternative DNS infrastructures that filter, rewrite, or selectively resolve queries—can lead to situations where a domain is accessible in one country but unreachable or redirected in another. This undermines the universality of the web, frustrates cross-border communication, and erodes trust in the internet’s core functionality. It also introduces new risks of misconfiguration, security vulnerabilities, and DNS spoofing, especially if alternative systems are not held to the same operational standards as the global DNS.

These sovereignty-driven divergences also complicate the role of ICANN and challenge the multistakeholder governance model it represents. ICANN’s legitimacy relies on the perception that it operates in a technically competent, politically neutral manner, balancing diverse global interests without favoring any single state. However, when powerful states develop their own DNS infrastructures and bypass ICANN’s processes, they weaken the coherence of the system and signal that global coordination is secondary to national control. While ICANN has no formal authority to prevent countries from establishing independent DNS roots, it has repeatedly warned that doing so could lead to a “fragmented internet” or “splinternet,” where users in different jurisdictions experience fundamentally different versions of the internet.

Moreover, national internet sovereignty laws often require internet service providers, domain name registrars, and content hosts to comply with localized content restrictions and data localization mandates. This places global DNS operators in a precarious position, as they must navigate conflicting legal obligations. For instance, a registrar accredited by ICANN may be pressured by a national government to de-list or block access to a domain that violates local laws, even if the domain is legally permissible under international norms. The case of Turkey blocking access to Wikipedia, or Iran blocking thousands of domains considered morally or politically unacceptable, illustrates how DNS-level interventions can be used to enforce domestic law at the cost of global openness.

Adding another layer of complexity is the increasing deployment of DNS over HTTPS (DoH) and DNS over TLS (DoT), which encrypt DNS queries to protect user privacy and prevent censorship. While these technologies are lauded by privacy advocates, they are viewed with suspicion by governments seeking visibility and control over internet traffic. In response, some states have proposed or implemented regulations that limit the use of encrypted DNS or require users to rely solely on state-approved resolvers. These measures again raise the specter of DNS fragmentation, as users in these countries are effectively isolated from the global DNS ecosystem, relying instead on localized versions that serve state interests.

Despite the growing momentum behind internet sovereignty, not all countries advocating for stronger digital control necessarily threaten DNS interoperability. The European Union, for instance, has enacted robust data protection laws like the General Data Protection Regulation (GDPR) and proposed regulations to curb disinformation and promote digital sovereignty. However, its approach has largely operated within the bounds of global internet standards, without creating parallel DNS infrastructures. The EU’s model suggests that it is possible to assert national or regional policy priorities without compromising the core technical unity of the internet. Nonetheless, the trend among authoritarian regimes to build alternative DNS systems and restrict cross-border data flows indicates a broader shift that could accelerate digital balkanization.

The long-term consequences of fragmented DNS infrastructures are profound. Not only do they threaten the reliability and consistency of the internet, but they also undermine the idea of a shared, global communications space. For businesses, this fragmentation creates new barriers to market entry, increased compliance costs, and heightened legal uncertainty. For civil society, it restricts access to information, hampers advocacy efforts, and reinforces state censorship. For the technical community, it complicates the already complex task of maintaining a secure and resilient DNS environment.

Ultimately, the challenge lies in reconciling legitimate national security and policy concerns with the need to preserve a unified and interoperable DNS. This will require renewed commitment to multistakeholder governance, technical cooperation, and diplomatic engagement. It may also demand new frameworks for international internet law that clarify the rights and responsibilities of states in managing their digital infrastructure without isolating themselves—or their citizens—from the global internet. As more countries contemplate the path of internet sovereignty, the stakes for DNS interoperability grow ever higher. Whether the world can maintain a shared digital commons or retreats into a series of isolated digital enclaves may well hinge on how this tension is resolved.
