Claiming the Digital Sacred Can Indigenous Communities Secure Control Over Their TLDs?

As the internet expands and new naming systems develop across digital territories, indigenous communities around the world are asking a profound question: can they assert sovereignty over the very top-level domains (TLDs) that correspond to their identities, languages, and lands? In an era when domain names represent far more than addresses—standing in as cultural signifiers, political banners, and economic gateways—the question of who controls these powerful digital assets is far from trivial. For many indigenous groups, gaining control over relevant TLDs is not just a matter of branding or revenue, but a fight for cultural preservation, autonomy, and self-determination in cyberspace. Yet the road to recognition in the domain name system is fraught with policy complexity, commercial interests, and a global governance structure that has historically marginalized indigenous voices.
The issue emerges from the global expansion of generic top-level domains that began in earnest in 2012, when the Internet Corporation for Assigned Names and Numbers (ICANN) launched its New gTLD Program. The program allowed applicants—corporations, organizations, and governments—to propose and operate new TLDs beyond traditional ones like .com, .org, or .net. This expansion produced strings like .amazon, .nyc, .catholic, and .africa. Many of these were contested, especially when the proposed string bore the name of a region, cultural group, or linguistic community.
For indigenous peoples, the stakes are unique. Many of their names, linguistic markers, or regional identifiers have deep cultural significance and are vulnerable to appropriation if claimed by non-indigenous entities. A community such as the Māori of Aotearoa (New Zealand) may wish to assert control over a TLD like .maori or .aotearoa to protect cultural content, promote language revitalization, and ensure indigenous-led development of digital resources. Similarly, Native American tribes, First Nations in Canada, Aboriginal groups in Australia, and stateless peoples like the Sámi of Northern Europe have all expressed interest in owning or governing TLDs that reflect their collective identities.
However, the existing TLD governance framework presents several barriers. ICANN’s processes require applicants to pay high upfront fees—$185,000 during the 2012 round—and to demonstrate technical and operational capacity to run a registry. These requirements, though ostensibly neutral, effectively exclude many indigenous communities that lack access to financial capital or technical infrastructure. Even when partnerships are formed with backend operators or technical firms, the process is daunting and resource-intensive, demanding extensive legal and procedural navigation.
Moreover, ICANN’s community objection process has not consistently protected indigenous interests. A notable example is the .amazon dispute. When Amazon Inc. applied for the .amazon TLD, several South American governments, on behalf of the Amazon Cooperation Treaty Organization (ACTO), filed objections citing cultural and geographical significance. Despite years of resistance and negotiation, Amazon was eventually awarded control over the TLD in 2019, subject to certain commitments. The case set a troubling precedent: even when objections are rooted in protecting cultural or regional identity, commercial interests may ultimately prevail in ICANN’s decision-making framework.
While indigenous communities differ from sovereign states, the .amazon case illustrates how naming rights—even of globally significant terms—can be ceded to corporate entities. For indigenous applicants, who may not have formal state representation or access to diplomatic channels, the challenge is even greater. ICANN has acknowledged the importance of community-based applications, but its policies often prioritize stability, security, and economic viability over social or cultural equity.
There are, however, a few positive examples that hint at what is possible. The .cat domain, while not indigenous per se, is operated by the Fundació puntCAT on behalf of the Catalan linguistic and cultural community. Though it required substantial political and financial backing, the success of .cat opened the door to the idea that non-state cultural groups could responsibly manage their own digital namespace. The .scot domain, operated by the DotScot Registry, similarly promotes Scottish identity and culture, although Scotland exists within a recognized nation-state framework. These cases are instructive but also highlight the privileged pathways available to communities with national-level infrastructure or strong regional autonomy.
Efforts to create a TLD explicitly for indigenous communities have also surfaced. In 2014, the .indigi project, supported by indigenous groups in Australia, aimed to create a shared TLD for indigenous peoples globally. The vision was to provide a platform where cultural protocols, content, and representation could be developed and governed by indigenous rules. However, the initiative did not reach ICANN application, due in part to resource limitations and the sheer complexity of the application process. Nonetheless, it remains a reference point for what collaborative, culturally-grounded TLD governance could look like.
There is also growing recognition that TLD governance intersects with broader digital rights movements. Indigenous data sovereignty—the principle that indigenous peoples have the right to govern the collection, ownership, and application of data about their communities—is increasingly invoked in discussions about domain name governance. Control over a TLD would allow a community to define how its data is accessed, indexed, and monetized. It could also facilitate trust frameworks, language preservation projects, and community-driven ecommerce that avoids exploitative intermediaries.
The question, then, is not whether indigenous communities should control relevant TLDs—they have compelling cultural, ethical, and historical grounds for doing so—but whether the global domain name system is equipped to facilitate that control. ICANN, for its part, has acknowledged the need to improve inclusivity and has begun exploratory discussions about future rounds of TLD applications with lower-cost pathways or support for underserved applicants. However, real reform would require more than fee reductions. It would demand a rethinking of legitimacy, representation, and procedural equity in the way digital namespaces are allocated.
This might involve creating reserved lists for culturally sensitive strings, establishing indigenous-led advisory councils within ICANN, or recognizing collective identity rights in the evaluation of TLD applications. It might also require registrars and backend operators to offer technical and legal support to indigenous applicants, similar to public-interest technology incubators. Without such systemic changes, indigenous communities will remain largely on the outside of a digital property regime that continues to expand without them.
Control over a TLD offers more than visibility—it is a foundation for narrative sovereignty in the digital realm. In the same way that land rights and cultural heritage are vital to self-determination in the physical world, domain names are critical in cyberspace. They are the first impression, the namespace under which stories are told, businesses are built, and identities are asserted. If the global internet is to reflect the diversity and dignity of its users, then indigenous peoples must be empowered not just to participate in digital life, but to define its terms—including the ones that end in dot.
