RDNH Case D2019-1532

The case D2019-1532 involved a domain name dispute between Jemie B.V. and Canna Holding B.V., both from The Netherlands, as complainants, and Domain Administrator, PrivacyGuardian.org/J-J-It, Jacinto Harvey, from the United States, as the respondent. The disputed domain name was , registered on April 23, 2019. Jemie B.V. held several trademarks for “CANNA,” which they claimed were infringed upon by the domain name. The domain was used for a website offering Cannabidiol (CBD) products, indicating the complainant’s contact details. The complainants argued that the domain name was identical to their trade name and CANNA trademark, asserting that it was registered and used in bad faith. However, the respondent did not reply to the complaint.

The WIPO panel, chaired by Wilson Pinheiro Jabur, found that the domain name was confusingly similar to the complainants’ trademark. It also found that the respondent had no rights or legitimate interests in the domain name and that it was registered and used in bad faith, particularly given its association with fraudulent activities. Consequently, the panel ordered the transfer of the domain name to the complainants on September 4, 2019.
