Examination of WIPO Case D2019-0742: Sébastien Paches vs. Dvlpmnt Marketing, Inc.

In the WIPO domain name dispute case D2019-0742, Sébastien Paches, a Swiss resident, contested the ownership of the domain name “paches.com” against Dvlpmnt Marketing, Inc., a domain name dealer. Paches, who planned to start a clothing business under the “Paches” name and owned a Swiss trademark for it, argued that the domain name was essential to his business. However, the panel found that the domain name was acquired by the respondent before Paches trademarked the name. The complaint was denied on May 14, 2019, as there was no evidence of bad faith registration or use by Dvlpmnt Marketing, Inc.
