The WIPO domain name dispute case D2014-2041 involved a complaint by R.V. Kuhns & Associates, Inc. against Gregory Ricks/Whois Privacy Corp./Domain Administrator over the domain name . The complainant, R.V. Kuhns & Associates, Inc., alleged that it had rights in the “RVK” trademark related to investment consulting services and that the respondent’s use of the domain name was illegitimate and in bad faith. However, the panel found that the respondent registered the domain name before the complainant’s trademark rights were established and that the complainant could not have been aware of the complainant’s as-yet-nonexistent claim to the mark. Consequently, the complaint was denied, and the panel found that the complainant engaged in Reverse Domain Name Hijacking, attempting to use the policy in bad faith to deprive a registered domain-name holder of a domain name.
