Riskmethods GmbH vs. LEVEL2 LLC / Lever 10 Inc.: A Detailed Review of a Domain Dispute and RDNH

In the case of riskmethods GmbH v. LEVEL2 LLC / Lever 10 Inc. (Case No. D2019-0286), riskmethods GmbH, a German company offering specialized supply chain risk management services, filed a complaint against LEVEL2 LLC and Lever 10 Inc. for the domain name “riskmethods.com”. The domain was initially registered by LEVEL2 LLC and later sold to Lever 10 Inc. Riskmethods GmbH argued that the domain was identical to their registered trademarks.
The WIPO panel reviewed the case and acknowledged the Complainant’s registered trademarks. However, they noted that the term “risk methods” was descriptive and used in various analytic methods. Furthermore, Lever 10 Inc., based in the United States, where riskmethods GmbH had no exclusive rights over the term “risk methods” in their trademark, presented a plausible explanation for acquiring the domain. The Panel ultimately decided that riskmethods GmbH failed to prove Lever 10 Inc. had no legitimate interest in the domain, leading to the denial of the complaint. The Panel also rejected the claim of Reverse Domain Name Hijacking by the respondent.
