The governance of the Domain Name System (DNS) and the allocation of top-level domains (TLDs) have been emblematic of a broader trend in global internet governance: the emergence and institutionalization of multistakeholderism. As a concept, multistakeholder governance emphasizes the inclusion of diverse actors—governments, private sector entities, technical experts, civil society, and academia—in policymaking processes. This model is grounded in the belief that internet-related issues transcend traditional geopolitical boundaries and require collaborative, decentralized solutions. While ICANN has often been viewed as the leading institutional embodiment of multistakeholder governance in TLD administration, various other models around the world offer instructive contrasts. A comparative view of these governance frameworks reveals not only the strengths and limitations of multistakeholderism, but also its practical adaptations to different political, economic, and cultural contexts.

At the core of ICANN’s governance structure is a deeply institutionalized multistakeholder process. ICANN’s Supporting Organizations (SOs), Advisory Committees (ACs), and stakeholder groups are divided according to functional roles and interests. The Generic Names Supporting Organization (GNSO) develops policy for generic top-level domains through a bottom-up consensus model involving registries, registrars, businesses, non-commercial users, intellectual property advocates, and internet service providers. The Governmental Advisory Committee (GAC) provides non-binding public policy advice from over 170 governments. The At-Large Advisory Committee represents individual users. Its board includes equal representation from government, the private sector, civil society, the technical community, and academia. Decisions are made by consensus, and the committee plays a central role in shaping internet policy, promoting digital inclusion, and supporting innovation. The success of CGI.br stems from its formal legal status, consistent government support, and a strong culture of consensus-building. It demonstrates how multistakeholderism can be embedded into national policy without being dominated by state interests.

Germany offers another variant, where the governance of the .de ccTLD is handled by DENIC, a cooperative that includes internet service providers and other stakeholders as members. While DENIC operates with considerable autonomy, it maintains a consultative relationship with the German government and civil society. This model reflects a public-private partnership approach, with a focus on technical efficiency and service provision. Unlike ICANN, which operates in a global multilateral environment, DENIC functions within a clearly defined national jurisdiction, allowing for more streamlined governance. However, its stakeholder participation is narrower in scope compared to broader multistakeholder forums, and its decisions are primarily driven by operational rather than normative considerations.

In the Asia-Pacific region, multistakeholderism has been adapted to suit diverse political systems. For example, the governance of .in in India involves the National Internet Exchange of India (NIXI), a not-for-profit entity established by the government. While NIXI includes representatives from academia and industry, the government retains a predominant role. Public consultation occurs, but decision-making authority is centralized. This model exemplifies a hybrid form of multistakeholderism where the state acts as both convenor and regulator, balancing openness with control. It raises important questions about how multistakeholder principles can coexist with strong governmental oversight, especially in countries where state capacity is central to digital development.

The European Union’s approach to internet governance incorporates multistakeholder principles through consultative processes and collaboration with entities such as EURid, the operator of the .eu TLD. While the European Commission ultimately holds legal responsibility for the .eu domain, EURid works with advisory bodies that include civil society and industry representatives. This arrangement aligns with the EU’s broader regulatory model, which emphasizes rule of law, public consultation, and institutional checks and balances. However, EU governance is also characterized by a complex regulatory apparatus that may limit the agility and responsiveness often associated with bottom-up models.

The comparison between these models underscores the flexibility of multistakeholder governance as a framework rather than a fixed formula. In ICANN, the model is global, formalized, and procedurally intensive. In Brazil, it is national, consensus-driven, and embedded in political culture. In Germany, it is operational and industry-led. In India, it is hybridized and government-anchored. In the EU, it is regulatory and consultative. Each model adapts to its environment while attempting to uphold core values of inclusivity, transparency, and legitimacy. However, all face common challenges: ensuring balanced representation, managing conflicts of interest, sustaining participation over time, and maintaining effectiveness in a rapidly changing digital landscape.

As internet governance issues grow in complexity—from data sovereignty and artificial intelligence to cybersecurity and content moderation—multistakeholder models will need to evolve. This may involve integrating new stakeholders, including marginalized groups and emerging economies, or developing more agile and iterative decision-making processes. Comparative analysis offers valuable insights into how diverse institutional arrangements can support shared governance, and how these arrangements might be harmonized or interfaced across levels of governance. Ultimately, the resilience and legitimacy of multistakeholder governance will depend on its ability to adapt while remaining anchored in the principle that the internet, as a global public resource, should be governed by all who use it.
